Do you have a defence?   Answering this question will rely upon the essential elements of the offence and the classification of the offence. There are three categories under which an offence may fall. They are the following:

Are you required to attend court?   The Provincial Offences Act allows a defendant to appear in court by way of counsel or agent. Depending on the type of offence, classification of the offence, and whether a defence is available, will determine whether your appearance is necessary. In many cases, your appearance is not necessary and can be handled by one of our experienced agents in your absence. We at HWY-LAW recognize that many persons charged with an offence prefer not to attend court, if unnecessary, either due to work related commitments or the potentially stressful nature of a court proceeding. Ultimately, the decision is made by you and we act on your behalf accordingly.
